Terms & Conditions
These Terms & Conditions govern all services provided by Social Concept Marketing Agency ("SCMA"). By signing a service agreement or engaging SCMA for services, the Client agrees to the following terms.
1. Scope of Services
Services provided by SCMA may include, but are not limited to:
Social Media Management
Content Creation
Community Management
Brand Strategy
Marketing Strategy
Content Planning
Graphic Design
Copywriting
Email Marketing
Blog Writing
Website Content
Google Business Profile Management
Business Coaching
Consulting
Additional marketing services as outlined in the Client's agreement.
Only services specifically outlined in the Client Agreement are included in the monthly package.
2. Client Responsibilities
The Client agrees to:
Provide accurate information needed to complete services.
Provide requested materials in a timely manner.
Maintain ownership and access to all business accounts unless otherwise agreed.
Respond to requests for approvals or revisions within a reasonable timeframe.
Notify SCMA of any business changes that may affect marketing efforts.
Delays in communication or approvals may delay content scheduling and project timelines.
3. Content Approval
All content requiring approval must be reviewed before its scheduled publication date.
If approval is not received before the scheduled posting date, SCMA reserves the right to:
Delay publication
Adjust the posting schedule
Publish previously approved content if applicable
The Client is responsible for reviewing all content for accuracy before approval.
4. Revisions
Reasonable revisions are included as outlined in the Client Agreement.
Revisions requested after approval or after content has been published may be considered additional work and billed separately.
5. Posting Schedule
SCMA will make every reasonable effort to publish content according to the agreed-upon schedule.
Occasionally, posting times may vary due to:
Platform outages
Software limitations
Internet disruptions
Third-party scheduling platform issues
6. Community Management
If Community Management is included in the Client's package, SCMA will:
Monitor comments
Respond to messages
Engage with followers
Escalate questions requiring the Client's input
SCMA will not provide legal, medical, financial, insurance, or other professional advice on behalf of the Client.
7. Account Access
Clients maintain ownership of all social media accounts.
The Client agrees to provide the necessary access for SCMA to perform the contracted services.
If access is removed or restricted, SCMA is not responsible for missed deadlines or delayed services.
8. Intellectual Property
Unless otherwise agreed in writing:
All original content created by SCMA remains the intellectual property of SCMA until payment has been received in full.
Upon full payment, the Client receives the right to use the approved content for their business.
SCMA reserves the right to display completed work within its portfolio and marketing materials unless otherwise requested in writing.
9. Confidentiality
SCMA agrees to maintain the confidentiality of all non-public business information shared by the Client.
Likewise, the Client agrees not to distribute SCMA's proprietary processes, templates, training materials, pricing, or internal documentation without written permission.
10. Payment Terms
Invoices are due according to the payment schedule outlined in the Client Agreement.
Late payments may result in:
Late fees, if applicable
Suspension of services
Delayed scheduling
Temporary removal from the content calendar
Services may resume once the account is brought current.
11. Cancellation
Either party may terminate services according to the notice period outlined in the Client Agreement.
Any completed work, scheduled content, or outstanding balances remain due upon termination.
12. Results Disclaimer
Marketing outcomes vary based on numerous factors beyond SCMA's control.
While SCMA uses proven strategies and industry best practices, no guarantee is made regarding:
Revenue
Leads
Sales
Search rankings
Follower growth
Engagement metrics
13. Third-Party Platforms
SCMA is not responsible for changes made by third-party platforms, including but not limited to:
TikTok
YouTube
Meta
GoHighLevel
Canva
Monday.com
Platform outages, policy updates, algorithm changes, or account restrictions are outside of SCMA's control.
14. Limitation of Liability
SCMA shall not be liable for indirect, incidental, consequential, or special damages arising from the use of its services.
The Client agrees that SCMA's total liability shall not exceed the amount paid by the Client for services during the preceding thirty (30) days.
15. Acceptance
By signing the Client Agreement or engaging SCMA's services, the Client acknowledges that they have read, understood, and agree to these Terms & Conditions.
